Advisory Opinion No. 96-36

Re: Terrence P. Donnelly, Esq.

Question Presented

A state employee holding the position of Assistant Attorney General requests an advisory opinion as to whether he is required to file an annual Financial Statement as a state appointed official given that attends meetings of the State Medical Examiners Commission as the representative of the Attorney General, who serves on the Commission ex officio.

Response

The Code of Ethics does not require that the representatives or designees of elected or appointed officials, who attend meetings of or serve on boards or commissions in the place of those officials, file annual Financial Statements. Such representatives or designees are not elected or appointed officials within the meaning of R.I. Gen. Laws §§ 36-14-16, 36-14-4(a) and (b).
