Question Presented

A Deputy Chief of Police requests an advisory opinion as to whether he is required to file an annual Financial Statement as a municipal appointed official given that he serves in his position by virtue of an appointment through the police department.

Response

The Code of Ethics does not require that a Deputy Chief of Police, who serves in his position by virtue of an appointment through the police department, file an annual Financial Statement. The nature of the petitioner's appointment does not make him a municipal appointed official within the meaning of R.I. Gen. Laws §§ 36-14-16, 36-14-4(a) and (b).
