Question Presented

An Acting Superintendent of Schools in the Town of Burrillville, appointed to that position by the town's School Committee, requests an advisory opinion as to whether he is required to file an annual Financial Statement as a municipal appointed official.

Response

The Code of Ethics does not require that an Acting Superintendent of Schools in the Town of Burrillville, appointed to that position by the town's School Committee, file an annual Financial Statement. The School Committee is not the highest legislative body of the local government nor is the petitioner's term of office specified by a statute, charter or ordinance; therefore, the petitioner is not a municipal appointed official within the meaning of R.I. Gen. Laws §§ 36-14-16, 36-14-4(a) and (b).
