Re: Urbano Prignano, Jr.

Question Presented

The Chief of Police in the City of Providence, who serves in his position by virtue of an appointment by the Commissioner of Public Safety and who serves at the pleasure of said Commissioner, requests an advisory opinion as to whether he is required to file an annual Financial Statement as a municipal appointed official.

Response

The Code of Ethics does not require that the Chief of Police in the City of Providence, who serves in his position by virtue of an appointment by the Commissioner of Public Safety and who serves at the pleasure of said Commissioner, file an annual Financial Statement. The petitioner's appointment is not made by the governing body or highest official of the City of Providence, nor does the Chief of Police serve for a term specified by statute, ordinance or charter; therefore, he is not a municipal appointed official within the meaning of R.I. Gen. Laws §§ 36-14-16, 36-14-4(a) and (b).
