Question Presented

The Deputy Policy Director to the Governor requests an advisory opinion as to whether she is required to file an annual Financial Statement.

Response

The Code of Ethics does not require the petitioner to an employee of the Governor's office serving in the position of Deputy Policy Director, to file an annual Financial Statement. The Code of Ethics requires all state and municipal elected officials and state and municipal appointed officials to file an annual financial statement with the Ethics Commission. (See R.I. Gen. Laws § 36-14-16) The Deputy Policy Director position is not a state appointed official since she is not appointed for a term of office specified by statute or by the highest governing authority.
