Question Presented

The Chief Engineer for the Pawtucket Water Supply Board, an employee who serves as the agency's executive officer, requests an advisory opinion as to whether he is required to file an annual Financial Statement under the provisions of the Code of Ethics.

Response

The Code of Ethics does not require the petitioner, the Chief Engineer and executive officer employed by the Pawtucket Water Supply Board, to file an annual Financial Statement. The Code of Ethics requires all state and municipal elected officials and state and municipal appointed officials to file an annual financial statement with the Ethics Commission. (See R.I. Gen. Laws § 36-14-16) The Chief Engineer is not a municipal appointed official since he is not appointed by the governing body of the municipal government and is not appointed for a term of office specified in the City Charter.
