QUESTION PRESENTED
The Petitioner, a member of the State Medical Examiners Commission, a state appointed position, requests an advisory opinion as to whether he is required to file a personal financial disclosure statement.
RESPONSE
It is the opinion of the Rhode Island Ethics Commission that the Petitioner, member of the State Medical Examiners Commission, a state appointed position, is required to file a personal financial disclosure statement. Pursuant to R.I. Gen. Laws § 23-4-6, the President of the Rhode Island Bar Association serves as an ex-officio member of the State Medical Examiners Commission. Other members of the Commission are others who sit ex-officio as well as citizens appointed by the Governor. The Commission hears and determines appeals to decisions by the chief medical examiners. Based on this information, the Petitioner is a "state or municipal appointed official" within the meaning of R.I. Gen. Laws § 36-14-4 or §36-14-16, and, therefore, pursuant to legislative mandate is required to file a financial statement.
