QUESTION PRESENTED

The Petitioner, a South Kingstown Election Clerk, a municipal appointed position, requests an advisory opinion as to whether she must file a personal financial disclosure statement.

RESPONSE

It is the opinion of the Rhode Island Ethics Commission that the Petitioner, a South Kingstown Election Clerk, a municipal appointed position, is not required to file a personal financial disclosure statement. The Petitioner is appointed by the Town Clerk and only works during elections. Given that the position is not appointed for a term of office specified by the constitution, statute, charter, or ordinance and is not appointed by the South Kingstown Town Council or Town Manager, the Petitioner is not a "state or municipal appointed official" within the meaning of R.I. Gen. Laws § 36-14-4 or §36-14-16, and therefore is not required to file a financial statement.
