QUESTION PRESENTED

The Petitioner, the Superintendent of Parks for the City of Providence, a municipal appointed position, requests an advisory opinion as to whether she must file an annual financial disclosure statement.

RESPONSE

It is the opinion of the Rhode Island Ethics Commission that the Petitioner, the Superintendent of Parks for the City of Providence, a municipal appointed position, must file an annual financial disclosure statement. The Board of Park Commissioners appointed the Petitioner, and the Charter provides that the Superintendent shall serve a term of not more than five years. See City of Providence Charter, Art. X, §1003. As defined in the Code of Ethics, "state and municipal appointed officials” include not only persons appointed by the highest governing official of a state or municipality, but also those persons whose terms of office are specified by Constitution, statute, charter or ordinance. See R.I. Gen. Laws § 36-14-2(4). As defined, the Petitioner is a “state and municipal appointed official” and must file the disclosure statement with the Ethics Commission. See R.I. Gen. Laws §§ 36-14-4, 16.
