QUESTION PRESENTED

The petitioner, the Superintendent of Schools for the Chariho Regional School District, a regional appointed position, requests an advisory opinion as to whether he is required to file a personal financial disclosure statement pursuant to the Code of Ethics.

RESPONSE

It is the opinion of the Rhode Island Ethics Commission that the petitioner, Superintendent of Schools for the Chariho Regional School District, a regional appointed position, is not required to file a personal financial disclosure statement. The petitioner is appointed by the School Committee for the Chariho Regional School District. Since he is not appointed by or through the highest governing body or highest official of municipal government, nor does his position have a term of office specified by statute, charter, or ordinance, the petitioner, is not a “state or municipal appointed official” within the meaning of R.I. Gen. Laws § 36-14-4 or §36-14-16. Accordingly, he is not required to file a financial disclosure statement.
